Terms of service

The terms of our Modelo 210 service: what we do and what we need from you, the price, deadlines, your right of withdrawal and our responsibility.

Last updated: October 29, 2026

These terms apply to the services of CasitaTax, a trading name of ZAHARD LTD, 71-75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom, company number 14503377, VAT GB 452262020, contact@casitatax.com (“we”).

1. The service

We prepare your Modelo 210, the Spanish non-resident income tax return, and file it on your behalf with the Agencia Tributaria once you have approved the figures. We then send you the filed return and its receipt. When a home has several owners, each of them has their own return.

The service covers the returns of the plan you choose, for every owner of the home: Not rented out, the return for owning the home, each year; Rented out, the returns for owning the home and for the rental income, each year; Sold, the return for the sale. Past years to catch up on are agreed with you separately. The service does not include advice on your taxes in your country of residence, nor other Spanish returns or procedures, unless we agree on them in writing.

CasitaTax is a private service, not affiliated with the Agencia Tributaria. Filing Modelo 210 is free, and you can do it yourself: our price covers the service of preparing and filing it for you.

The tax is not included. The tax shown on your return, and any surcharge or interest, is owed by you to the Agencia Tributaria: it is not part of our price.

2. How a contract is made

Writing to us costs nothing and does not commit you. We then get back to you to confirm the plan that fits your situation, its price and the documents we need. The contract is made when you confirm your order with us and pay, outside the website. We confirm it by email.

3. What we need from you

  • For each owner: their NIE, a copy of their passport or identity card, and their address in their country of residence.
  • For the home: the latest IBI receipt and the title deed (escritura).
  • If you rent it out: the rent received and, for residents of the EU and the EEA, the expenses to deduct.
  • If you sold it: the sale and purchase deeds.
  • The authorisation to file on each owner’s behalf, signed, when we ask for it.

You confirm that the information and documents you send are accurate and complete, and that they are yours or that you may send them, in particular for the other owners. Tell us about any change that affects your returns: a sale, a rental, a new country of residence.

4. Deadlines

We file each return before its deadline, provided we have your complete documents and your approval of the figures in good time. When they reach us late, we file as soon as we can, without any guarantee of meeting the deadline. Returns filed after their deadline, such as those of past years we catch up on, come with surcharges and interest: these are owed by you.

5. Price and payment

Our prices are shown on the website and include VAT. They cover up to 2 owners per home: Not rented out, €122 a year; Rented out, €374 a year; Sold, €299, paid once. Each additional owner adds €54 to the plan’s price. Past years to catch up on are quoted before you order.

The yearly plans (Not rented out, Rented out) are subscriptions: each year, we file the returns of the tax year that is due. They renew automatically on the anniversary of your order, at the price then shown on the website. We email you before each renewal, with its date and its price. You can cancel at any time, free of charge, by writing to contact@casitatax.com: the subscription then ends at the next renewal date and you pay nothing more. A year already paid is not refunded once we have started work on its returns, except under your right of withdrawal.

You pay when you order, on the secure payment page of Stripe, our payment provider, by card or with another method it offers; we never see your full card number. For the yearly plans, each renewal is charged to the same payment method.

6. Right of withdrawal (consumers)

If you are a consumer, you can withdraw from the contract within 14 days of the day it is made, without giving any reason. To withdraw, tell us clearly, for example by email to contact@casitatax.com, or with the model form below. We refund you within 14 days, by the means you used to pay.

If you ask us to start the service before the 14 days end and then withdraw, you pay for the part already done. You only lose the right of withdrawal once the service is fully performed, if you expressly asked us to start early and acknowledged that you would lose it at that point: a return filed with the Agencia Tributaria cannot be taken back.

The right of withdrawal is for consumers only: it does not apply when you order for a business.

7. If a return cannot be filed

  • Missing documents. If we have not received the documents we need within 5 weeks of your order, we may end the contract. The price is then not refunded, unless mandatory law provides otherwise.
  • Your information. Delays, errors, surcharges or interest caused by information or documents that are incorrect, incomplete or sent late are your responsibility, and do not give rise to a refund.
  • Modelo 210 does not apply. If it turns out that Modelo 210 is not the right return for you (for example, because you are a tax resident in Spain), or if the service is misused, we may refuse or stop the service. The work already done remains due; work not yet started is not charged.
  • Decisions of the administration. The Agencia Tributaria can check a return, ask for documents or correct it. We file returns that are complete and correct based on the information you give us, but we do not control its decisions or its delays.

8. Our responsibility

We do our best to prepare correct returns and to file them on time. We are not responsible for the decisions or delays of the Agencia Tributaria, nor for errors in the information you give us. Our liability is limited to the price you paid for the service, and we are not liable for indirect losses, except where the law does not allow such limits. Nothing in these terms limits your rights as a consumer under the law of your country.

9. Personal data

10. Complaints

11. Law and courts

These terms are governed by the law of England and Wales. If you are a consumer living in the European Union, you keep the protection of the mandatory rules of your country, and you can bring a claim before the courts of your country. If you live in Scotland or Northern Ireland, you can also bring a claim before your local courts.
